Concealing Prior Marriages Can Warrant Annulment

A single, concealed prior marriage does not warrant
annulment because the prior marriage “in no way
impedes the carrying out of the marital obligations
and does not go to the fundamentals of the
relationship.” But one court found that concealing
five of seven prior marriages is fraudulent. In this
case, concealing five of eight prior marriages
constituted fraud because it “clearly goes to the
essentials of the marriage.” Leax v. Leax, No.
01-08-00149-CV (Tex. App. - Houston [1st Dist.] June
11, 2009).
